Server Use

ITL reserves the right to refuse service and/or access to its servers to anyone.

ITL does not allow adult material - including all pornography, erotic images, or otherwise lewd or obscene content or excessive download content or non-linked content to be stored on its servers:

Refusal of service based on content matching either of these two criteria is entirely at the discretion of ITL.

ITL reserves the right to move Customer domain to a different web server without prior notice.

Unlimited Use policy

High bandwidth usage: ITL offers an unlimited use policy by maintaining very large ratios of bandwidth per Customer. In rare cases, ITL may find a Customer to be using server resources to such an extent that he or she may jeopardise server performance and resources for other Customers. In such instances, ITL reserves the right to impose the High Resource

Use Policy for the consideration of all Customers.

High Resource Use Policy

Resources are defined as bandwidth, processor utilisation or disk space.

When a web site is found to be monopolising the resources available ITL reserves the right, at its sole discretion, to suspend that site immediately. This policy is only implemented in extreme circumstances and is intended to prevent the misuse of our servers. Customers may be offered an option whereby ITL continues hosting the web site for an additional fee.

Acceptable Use Policy

ITL does not allow any of the following content to be stored on its servers:

  • Adult material - includes all pornography, erotic images, or otherwise lewd or obscene content.
  • Excessive download content or non-linked content.

Web Site Hosting

1) ITL reserves the right to suspend or cancel a Customer's access to any or all services provided by ITL, where ITL decides that the account has been inappropriately used. ITL reserves the right to refuse service and/or access to its servers to anyone.

2) ITL offer unlimited web space and bandwidth with some account types. By this, we mean unlimited space for legitimate web site content and bandwidth for visitors to view it. All files on a domain must be part of the active web site and linked to the site. Multimedia content such as audio and video is acceptable provided it is streamed to the user, links to HTTP download of this content is not acceptable.

3) ITL will disable any domain that fails to adhere to the following criteria as soon as we are made aware, in line with current working practices:

  • The primary purpose of any site must be to provide web-based content to viewers. Files on the site must be linked to the web site.
  • Sites must not contain Warez, copyright or other illegal material. The onus is on you the Customer to prove that you own the rights to publish material, not for ITL to prove that you do not.
  • Sites must not contain pornographic or other lewd material. Adult material includes all pornography, erotic images, or otherwise lewd or obscene content. The designation of "adult material" is left entirely to the discretion of ITL.
  • Sites must not use excessive amounts of server resources. These include bandwidth, processor utilization and / or disk space. Please see the 'High Resource Use Policy' in the General Terms and Conditions.

Email

1) If ITL identify a mailbox or domain that is causing problems, we will either remove the offending mailboxes or change their settings to resolve the issue. In extreme cases, we will disable email or suspend all services to the domain as appropriate.

2) Common issues that cause problems are:

  • Where a mailbox receives large volumes of undeliverable email.
  • Where mailboxes have forwarders set to other mailboxes where mail cannot be delivered.
  • Where mailboxes have forwarders and/or auto-responders that generate circular mail loops.

3) Customer may not use ITL email services for any of the following:

  • To send messages or communications, which are unsolicited, offensive, abusive, indecent or obscene.
  • To send messages causing annoyance, inconvenience or anxiety to another user of the Internet.
  • To send messages for the purpose of Fraud and /or with the intention of committing a criminal offence.

4) To prevent the sending of bulk unsolicited mail, SMTP traffic to and from a server will be blocked where we identify a server that has an open mail relay and where a significant volume of mail is sent from a domain in a defined timescale, or where we have received significant volumes of complaints concerning unsolicited mail originating from a ITL hosted domain.

5) To prevent ITL IP Addresses being blocked by IP Address blocking, a domain held on ITL servers may be disabled where we have received significant volumes of complaints concerning unsolicited mail originating from or unsolicited email being sent to promote sites being hosted on a ITL server.

Domain Name Terms & Conditions

This section sets out the terms and conditions relating to your use of the domain name registration services provided by ITL to register an Internet domain name, as well as the registration of the domain name.

By completing the application and pre-registration process, (including payment of our fees), you the Customer acknowledge that you have read, understood, and agree to be bound by all the terms and conditions set out herein.

You acknowledge that the application process, registration and subsequent use of any domain name will be subject to the rules and policies from time to time of the relevant registry and you, the Customer agree to abide by all such rules and policies. Accordingly, you undertake to read those rules and policies and agree to them under these Terms and Conditions.

Our Authority and Governance

ITL processes your application for registration of domain name and submits the information to the registration authority. We provide administrative support in securing the registration and notify you, the Customer, of the outcome of the application.

For the avoidance of doubt, in no circumstances will ITL be liable to the Customer for any loss of profit, business or anticipated savings suffered by the Customer on account of a failure to obtain or loss of a domain.

This Agreement becomes effective upon acceptance by ITL, who may at their sole discretion and without ascribing any reason therefore, elect to accept or reject any application for registration of domain name, including but not limited to, rejection due to a request for registration of a prohibited domain name.
